Privilege to drive. A driver’s license is a contract according to the DMV, so in addition to violations of criminal statutes and codes, the Vehicle Code, for which you are held accountable under the law, you are also administratively responsible for your DUI or DWI arrest with the California DMV.

The DMV hearing officer allows hearsay and other evidence that normally would be excluded in a criminal case. This means the 5th amendment does not apply according to the DMV. This means you can be forced to incriminate yourself. This is why it is so important to have an attorney appear for you, so you don’t have to testify at the administrative hearing. You could say something that could harm your criminal case!!
