The DMV hearing officer allows hearsay and other evidence that normally would be excluded in a criminal case. This means the 5th amendment does not apply according to the DMV. This means you can be forced to incriminate yourself. This is why it is so important to have an attorney appear for you, so you don’t have to testify at the administrative hearing.
