If it is a first offense and a low Breathalyzer you may want to go to trial. If it’s a third offense and a strike, you may have no choice. The costs and expenses are a major consideration. We normally don’t charge a lump fee. We first try and resolve the case with pre trial motions to dismiss, or by reaching a compromise or simply convince the prosecutor the case must be dismissed due to justice. If that happens, we only charge the initial fee and you save the money you would have paid in advance for a trial that never happens.
